TERMS OF SERVICE
These Terms of Service (“Terms”) apply to all bookings, hires and services provided by Us On Film via www.usonfilm.co.nz
(“we”, “us”, “our”). by making a booking or using our services, you agree to these Terms in full. These Terms constitute the entire agreement between Us On Film and the customer.Any prior discussions, messages, emails, or social media conversations do not form part of the agreement unless confirmed in writing by Us On Film.

Us On Film provides camcorder and optional 35mm film camera hire, along with professional video editing services. Our service is designed to capture candid, unfiltered moments and is not intended to replace professional wedding photographers or videographers.
Due to the nature of the service, we do not guarantee the capture of specific moments, audio quality, framing, lighting, or overall footage quality.

All bookings are date-specific and subject to availability.
Your booking is only confirmed once:
A 50% non-refundable deposit has been paid, and
You have received written confirmation from us.
We reserve the right to decline or cancel bookings at our discretion if full payment or required information is not provided.

A 50% non-refundable deposit is required to secure your date.
The remaining 50% balance is invoiced one month before your hire date and must be paid in full before any equipment is shipped.
You may choose to pay in full upfront if preferred.
Invoices are issued via HNRY and/or Xero only.
Failure to pay the final balance on time may result in cancellation of your booking without refund.

All deposits and initial full payments are non-refundable.
If you cancel after equipment has been shipped, you are responsible for the full booking amount.
We do not offer refunds due to:
Change of mind
Dislike of editing style
Missed or incomplete footage
Courier delays outside our control
Weather events or unforeseen circumstances
Our full editing style and examples are available on our website, and by booking you acknowledge and accept this style.

We ship equipment using third-party courier services.
While we do our best to ensure timely delivery, we are not responsible for courier delays, including delays caused by:
Public holidays
Weather events
Courier backlogs or strikes
Responsibility for the equipment passes to you once delivery is confirmed.

You agree to:
Use the equipment with reasonable care
Follow all instructions provided
Not tamper with, modify, or attempt repairs
You must not:
Submerge equipment in water
Expose equipment to sand, saltwater, or extreme conditions
Use equipment while intoxicated in a way that risks damage
Normal cosmetic wear is expected. However, loss or damage beyond normal wear may incur repair or replacement costs, unless gear protection has been added to your booking.

If gear protection is purchased, it provides cover for unintentional, accidental physical damage that occurs during the hire period while the equipment is being used as instructed.
This may include:
Accidental drops or knocks
Minor internal faults caused by accidental impact
Normal wear beyond expected cosmetic use resulting from accidental handling
Gear protection does not cover the following:
Loss or theft of any equipment or accessories
Intentional damage or reckless behaviour
Water, liquid, sand, saltwater, moisture or humidity damage
Negligence or misuse, including but not limited to:
Leaving equipment unattended in public places
Use while excessively intoxicated
Failure to follow provided instructions
Rodent, vermin or insect damage
Corrosion or rust, unless corrosion treatment has been applied and maintained where offered
Electrical damage caused by incorrect charging, power surges, or use of non-supplied chargers
Tampering, disassembly, or attempted repairs
Loss or damage occurring during return shipping due to improper packing or failure to use the supplied return packaging
If damage occurs that is not covered by gear protection, the customer may be liable for repair or replacement costs up to the full replacement value of the equipment.
Us On Film reserves the right to assess all damage and determine whether it falls within the scope of gear protection. Gear protection does not convert the hire into an insurance policy and does not remove the customer’s responsibility to take reasonable care of the equipment at all times

The customer is fully responsible for all equipment supplied during the hire period.
If any equipment or accessories are lost, stolen, not returned, or returned in an unusable condition, the customer agrees to pay the full replacement cost of the affected item(s), regardless of whether gear protection was purchased.
This includes (but is not limited to):
Camcorders or film cameras
Batteries, chargers, memory cards, film, cases, bags, or accessories
Damage rendering equipment unsafe or uneconomical to repair
Replacement costs will be assessed based on:
Current market value, or
Full replacement value of the same or equivalent model
An invoice for replacement costs will be issued and is payable in full upon receipt.
Failure to return equipment or settle replacement costs may result in debt recovery action. Loss or theft caused by third parties, venues, guests, couriers, or circumstances outside the customer’s control does not remove the customer’s responsibility for replacement costs

Editing begins once all equipment is returned.
Delivery timeframes are estimates and may vary during peak periods.
We do not guarantee inclusion of specific moments, people, or audio.
Minor timing or stylistic differences are not grounds for refunds or revisions.
Raw footage is provided where included in your package.

We are not liable for delays, losses, or service interruption caused by events beyond our control, including but not limited to:
Power outages
Severe weather
Natural disasters
Equipment malfunction
Data corruption
Courier service disruptions
In the event of equipment failure, liability is limited to the amount paid for the booking

Unless you specifically request otherwise in writing, you grant Us On Film permission to use selected footage, images or stills captured during your hire for marketing and promotional purposes, including but not limited to:
Social media
Website content
Advertising
Portfolio and promotional materials
This may include short clips, still frames, or edited excerpts.
If you would prefer your footage not be used for marketing, you must opt out in writing or in our video and delivery form before or during your hire period. Opting out will not affect your booking, pricing, or service.
We will never sell your footage to third parties or use it in a way that misrepresents you or your event.

All bookings are subject to equipment availability.
While we make every effort to supply the specific camera selected, there may be rare circumstances where a particular model becomes unavailable due to damage, delayed returns, courier issues, or technical faults.
In these cases:
We will offer a comparable or upgraded replacement camera where possible
You will be given the option to accept or decline the replacement
If you choose to accept the replacement camera, the booking will proceed as normal and no refund will apply.
If you decline the replacement and we are unable to provide any suitable alternative, a refund will be issued for the affected portion of your booking.
We are not able to offer refunds where a suitable replacement is available and declined. Minor differences in model, appearance, or features do not constitute grounds for cancellation or refund where the replacement camera provides equivalent functionality.

Our editing style is a core part of the Us On Film service and is demonstrated across our website, social media, and previous work.
Editing preferences are collected via our Video & Delivery Form, which is your opportunity to select options such as:
Video title
Music preference (where applicable)
Overall edit direction or vibe
For this reason, we do not offer creative revisions once editing has been completed.
However, we are happy to make minor factual or technical corrections, including:
Incorrect or misspelled titles
Wrong music used where a selection was provided
Obvious technical errors (e.g. export issues)
Revisions do not include:
Changes to overall editing style, pacing, or structure
Re-edits based on personal taste or change of mind
Adding or removing specific moments not originally included
Requests to match another creator’s style
Where music selection is offered, we will either:
Use your chosen track, or
Select music that fits your selected vibe if no specific track is provided
By submitting your Video & Delivery Form, you acknowledge that this is your opportunity to communicate preferences and that the final edit reflects the information provided at that time.

These Terms of Service apply equally to all Us On Film engagements, including but not limited to:
Paying customers
Gifted hires
UGC creators
Brand partnerships
Collaborations, testers, or promotional agreements
Unless otherwise agreed in writing, collaborators and creators are subject to the same responsibilities, limitations, and conditions outlined in these Terms, including:
Equipment care and liability
Loss, theft, and replacement costs
Editing style and revision limitations
Social media and marketing use
Equipment availability and substitutions
Where a hire or service is provided free of charge or at a discounted rate, this does not remove responsibility for:
Damage, loss, or replacement of equipment
Compliance with return timeframes
Proper use of equipment
Any additional deliverables, usage rights, or content obligations specific to a collaboration must be agreed to in writing prior to the hire period. In the absence of a separate written agreement, these Terms of Service constitute the full agreement between Us On Film and the collaborator or creator.

All content created by Us On Film, including but not limited to:
Edited videos
Trailers and social media cuts
Website content
Branding, graphics, copy, and visual style
remains the intellectual property of Us On Film, unless otherwise stated in writing.
Unauthorised use, reproduction, modification, redistribution, or resale of any Us On Film content is strictly prohibited. This includes:
Downloading or screen-recording content for commercial use
Reposting content without permission or proper credit
Removing watermarks or branding
Using our work to promote competing services
Any unauthorised use may result in:
Immediate takedown requests
Invoicing for usage or licensing fees
Legal action where necessary
Nothing in these Terms transfers ownership of Us On Film intellectual property unless explicitly agreed to in writing. If you’re unsure whether a use is permitted, please get in touch we’re usually happy to approve reasonable sharing with credit.

All equipment must be returned by the agreed return date using the supplied return packaging and courier label.
If equipment is not returned by the due date, a late fee of $50 NZD per day, per kit will apply until the equipment is returned in full.
Late fees apply regardless of reason, including but not limited to:
Forgetting to return the equipment
Courier delays caused by late drop-off
Failure to use the supplied return label or packaging
If equipment is not returned within 7 days of the due return date, it may be deemed lost or stolen, and full replacement costs may be charged in accordance with our Loss, Theft & Replacement Costs section.
Late fees are payable in full and may be invoiced separately. Late fees do not replace or limit the customer’s responsibility for loss, damage, or replacement costs.

We use third-party courier and postal services to deliver and return all equipment.
While we do our best to meet estimated delivery timeframes, delivery dates are not guaranteed and are subject to factors outside our control.
Us On Film is not responsible for delays, loss, or disruption caused by:
Courier or postal service delays
Public holidays or peak shipping periods
Weather events or natural disasters
Customs processing or inspections
Incorrect delivery information supplied by the customer
Parcels being delayed, redirected, or temporarily held by courier services
Responsibility for the equipment passes to the customer once delivery is confirmed by the courier.
Courier delays do not constitute grounds for cancellation, refund, or compensation.
If equipment is delayed in transit or temporarily held, we will make reasonable efforts to assist in tracking or resolving the issue, but liability remains limited as outlined in these Terms. In the event equipment is confiscated, seized, or not released by a courier, customs authority, or third party, the customer may be liable for replacement costs where the equipment is not returned.

All legitimate payments are issued only via our official invoicing providers (HNRY and/or Xero) and from verified Us On Film email addresses.
We are not responsible for any payments made to:
Third parties falsely claiming to represent Us On Film
Fake social media accounts
Scam emails, messages, or websites
Bank details not issued directly by Us On Film
If a customer makes payment to a scammer or unauthorised party, this does not constitute payment to Us On Film, and the booking will remain unpaid.
It is the customer’s responsibility to verify payment details before transferring funds. If you are unsure about a payment request, please contact us directly prior to making payment. Us On Film is not liable for losses resulting from phishing, impersonation, or fraudulent activity by third parties.

By booking with Us On Film, you agree not to initiate a chargeback or payment dispute for services rendered in accordance with these Terms.
In the event of a chargeback or payment dispute:
We reserve the right to provide these Terms, booking confirmations, delivery records, and correspondence as evidence
Any fees incurred as a result of a chargeback may be passed on to the customer

All equipment is supplied fully charged and with functioning storage at the time of dispatch.
However, due to the nature of electronic equipment and user handling, Us On Film is not responsible for:
Batteries running flat during the hire period
Failure to recharge batteries during use
Storage reaching capacity due to extended or high-volume recording
Footage not captured due to flat batteries or full storage
It is the customer’s responsibility to:
Monitor battery levels during use
Recharge batteries as needed using the supplied chargers
Manage recording time and available storage during the hire period
Where multiple batteries or chargers are supplied, these are intended to support continued use but do not guarantee uninterrupted recording.
Battery life, recording duration, and storage capacity may vary depending on usage, settings, and environmental conditions. Flat batteries or full storage do not constitute equipment failure and are not grounds for refunds, re-edits, or compensation.

Us On Film provides accurate examples of our cameras, footage style, and editing approach across our website, social media, and marketing materials.
These examples are intended to represent the general look and feel of our service, but are not a guarantee of any specific outcome.
Final results may vary depending on factors outside our control, including but not limited to:
Who is filming
Lighting and environment
Movement, framing, and audio conditions
Battery management and storage usage
The nature and flow of the event itself
By booking with Us On Film, you acknowledge that:
Each hire produces a unique and unpredictable result
Personal expectations or assumptions about the outcome do not constitute a guarantee
Differences between example content and your final footage are not grounds for refunds or re-edits
Our service prioritises authenticity, candid moments, and real-life documentation over technical perfection or curated outcomes. The beauty of the service is that it captures moments as they happen imperfect, emotional, and real.

Us On Film is an alternative to traditional videography, not a replacement for it.
We do not operate as professional wedding or event videographers and do not provide:
Directed filming
On-the-day coverage by a professional operator
Multi-camera setups or guaranteed angles
Live audio capture, interviews, or formal documentation
Instead, our service is designed to offer a candid, guest-filmed, lo-fi, and documentary-style experience, capturing moments as they naturally unfold.
By booking with Us On Film, you acknowledge and accept that:
The service is fundamentally different from a traditional videography service
Results will vary based on who films, when, and how
Comparisons to professional videography outcomes are not applicable
Choosing Us On Film means choosing authenticity and emotion over curated perfection. If you are seeking guaranteed coverage, professional operation, or cinematic control, we recommend booking a traditional videographer in addition to or instead of our service.

If you choose to travel with Us On Film equipment, including domestic or international travel, you do so entirely at your own risk and responsibility.
It is the customer’s responsibility to:
Research and comply with all airline, airport, and transport regulations
Ensure equipment, batteries, and film are packed, carried, and declared correctly
Confirm whether equipment must be carried in hand luggage or checked baggage
Us On Film is not responsible for:
Equipment confiscated, delayed, damaged, or lost by airports, airlines, customs, or security authorities
Damage caused by X-ray scanning, security checks, or improper handling
Loss, exposure, or damage to film rolls due to failure to use appropriate X-ray protection (such as lead-lined film bags)
Battery damage, overheating, leakage, or failure caused by misuse, incorrect storage, or transport conditions
Fires, smoke damage, or safety incidents caused by improper handling or charging of batteries
If equipment, accessories, or film are lost, destroyed, confiscated, or rendered unusable during travel, the customer remains fully liable for replacement costs in accordance with these Terms.
International travel may carry additional risks, and Us On Film does not guarantee compatibility with overseas power systems, voltage requirements, or regulatory standards. Travel-related loss or damage does not constitute equipment failure and is not grounds for refunds, replacements, or compensation.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Consumer Guarantees Act 1993 (NZ) or other applicable New Zealand consumer laws.
Where services are supplied for business purposes, the Consumer Guarantees Act does not apply.

Bookings, hires, and services may not be transferred, assigned, or resold to another party without written approval from Us On Film.

Us On Film reserves the right to refuse service, cancel a hire, or terminate an active hire if we reasonably believe the equipment is at risk, these Terms are being breached, or customer conduct is abusive, unsafe, or unlawful.
We reserve the right to request identification or additional verification prior to dispatching equipment.

All equipment is subject to inspection upon return. Any damage, missing items, or issues identified during inspection may be invoiced separately following return.
Equipment returned in an excessively dirty condition (including sand, liquid residue, smoke, makeup, or food contamination) may incur a additional fee.

We do not guarantee compatibility with third-party devices, software, or systems not supplied by Us On Film.

All dates and times referenced in bookings, invoices, dispatch, and return periods are based on New Zealand time (NZST/NZDT) unless otherwise stated in writing.
For international bookings, including Australia, the customer acknowledges that:
Time zone differences do not alter hire start or end dates
Public holidays and weekends are assessed based on New Zealand time
Return deadlines are calculated using New Zealand time regardless of the customer’s location
Failure to account for time zone differences does not constitute grounds for late fee waivers, extensions, or refunds. Customers are responsible for factoring in time zone differences when planning use and returns.

Us On Film is not responsible for restrictions, rules, or actions imposed by venues, vendors, or third parties that affect use of the equipment

Clauses relating to payment, liability, intellectual property, loss, and dispute resolution survive the completion or termination of the hire.
